4. When might corporate manslaughter apply to a landlord in the event of a fatal fire?
Fire and Rescue Service Representative Response: The Corporate Manslaughter and Corporate Homicide Act 2007 states that an organisation is guilty of an offence if the way in which its activities are managed or organised causes the death of a person, and amounts to a gross breach of a relevant duty of care owed by the organisation. It only applies if the way in which the organisation’s activities were managed or organised by its senior management contributed a substantial element in the breach of that duty. Where the Regulatory Reform (Fire Safety) Order 2005 applies, there will be clear duties with which the responsible person must ensure compliance. If they were grossly negligent in failing to comply with these duties, then a case of corporate manslaughter could be bought, if the failure to comply with those duties resulted in a fatality. The key phrase is ‘grossly negligent’ and it would need to be proven that the breach of that duty fell below what could reasonably be expected of the organisation in the circumstances.

Celotex said in a statement on its website: “As we previously stated, our records show a Celotex product (RS5000) was purchased for use in refurbishing the building. This product has a fire rating classification of Class 0, in accordance with British Standards. Celotex RS5000 is the insulation component specifically tested as part of a system to British Standard BS8414-2:2005. When the system is designed and installed in line with this, RS5000 meets the criteria set out in BRE Report BR 135 ‘Fire performance of external thermal insulation for walls of multi storey buildings.
“We will of course assist the relevant authorities fully with any enquiries they have.”

Grenfell Tower renovation works were inspected 16 times by Kensington and Chelsea council, but these checks failed to prevent the use of the flammable cladding being blamed for spreading the fire that killed at least 79 people.

GavinBarwell has been accused of 'sitting on' a delayed fire safety review into building regulations that was carried out after a deadly fire at the Lakanal House tower block in south London in 2009.
The then-housing minister last year promised to publish a review of building regulations, including fire safety in tower blocks.
However, that review has as yet failed to materialise.
Barwell was walking towards Downing Street when he was accosted by journalists.
Refusing to answer questions, the former MP, who lost his seat at the General Election, said: ‘I can’t comment I’m afraid’.

We welcome the announcement of the Public Inquiry into the tragic incident at Grenfell Tower. In the immediate term, we have offered our full help and support to the relevant authorities, who are investigating the causes. We would also like to praise the tireless efforts and bravery of the emergency services who continue to deal with this tragic incident. Rydon Maintenance Limited completed a partial refurbishment of the building in the summer of 2016 for KCTMO (Kensington and Chelsea Tenant Management Organisation) on behalf of the Council, which met all required building regulations - as well as fire regulation and health & safety standards - and handover took place when the completion notice was issued by Royal Borough of Kensington and Chelsea building control. “I am personally shocked and devastated by what has happened at Grenfell Tower and my thoughts are with the families and friends of those affected. We have been working with local authorities for nearly forty years and safety and quality are integral to everything we do at Rydon. I will do all I can to assist in this investigation in order to establish what caused this tragedy.
